1. Who is WIBS PHP INC.?

We (WIBS PHP INC., our, us) aim to provide users (customers, you) with an electronic payment service named “DO PAY for E-Money” and a virtual currency exchange called “DO PAY for VASP” depending on your needs.

We value the importance of your personal information, so we made our privacy policy under the Data Privacy Act of 2012 and the laws of the Philippines. This privacy policy was created to show our commitment to protecting your safety and privacy while remaining transparent. This will help you understand how we collect, store, use, share and protect the data you have given us.

WIBS PHP INC. Is a service operator with the license authenticated by Bangko Sentral ng Pilipinas (BSP) as Electronic Money Issuer Non-Bank Financial Institution (EMI-NBFI) and Non-Bank Virtual Asset Service Providers (Non-Bank VASP).

2. What Personal Information do we collect?

We define personal information in this Privacy Policy in accordance with the Data Privacy Act of 2012 as follows:

1. Basic Identifying Information. This includes your full name, date of birth, residential address, postal code email address, and gender.
2. Government Issued Identification. This includes your driver’s license, professional license, passport, or other government issued documentation.
3. Payment Information. This includes your financial payment details such as debit/credit card information or bank account details.
4. Recipient’s Identifying Information. This includes your recipient’s full name, date of birth, residential address, and email address.
5. Transaction Information. This includes your transaction history such as a unique reference ID, purpose of transaction, relationship with the recipient, amount of transaction and its frequency. All this information is collected in compliance with anti-money laundering regulations.
6. Technical Information. This includes data you use to access our services such as data from your network and devices used to access our service.
7. Customer Support Information. This includes any information you provide to our customer support allowing us to provide you with the best user experience possible.
8. Marketing and Communications Information. This includes information on marketing, research, and analysis to improve and enhance the quality of the Company’s products and services. This also includes information as to when our Privacy Policy, Terms & Conditions or other services are changed or updated.
9. Promotional Information. This includes notification or email on products and services as well as various campaigns from the company that may benefit you as a user.
10. Survey Information. This includes any information you provided voluntarily through feedback or survey to innovate and improve our service.

Use of Personal Information

All the information defined above is to be used by WIBS PHP Inc. based on laws and regulations. The information you have entrusted us with will allow us to manage your account and provide you with a secure platform. This allows us to seek verification of the customer’s and recipient’s account at financial institutions and the transactions associated with our services. We may also use the information you have provided in emergency situations to contact you.

The information you have provided will be used by us to innovate and improve our service. This will also be used to provide maintenance and support to the company by giving you world-class user experience. Any act that breaches our Terms (Hereinafter referred to as the “Terms”), Policy, etc. regarding the service of the company.

3. How do we collect Personal Information from you?

1. When you personally register for our service.

We shall only properly acquire personal information from you without deception or other fraudulent means.

Provision to third parties

We will never provide personal information to a third party without your consent unless disclosure is permitted in accordance with the Data Privacy Act of 2012 and other laws and regulations. The following cases shall not be regarded as a provision to the third party:

1. There is a case when personal information is provided upon succession of business due to merger or other reasons
2. There is a case when the Company entrust all or part of the handling of personal information to the third party that is necessary for achieving the purpose of use

4. How do we store your Personal Information?

Security management of personal information

We will provide the necessary and appropriate measures to ensure all employees of the WIBS PHP Inc. Are supervised so that personal information is safely managed against risks such as loss, destruction, falsification, and leakage of personal information. In addition, when we entrust all or part of the handling of personal information to a third party, we will conduct necessary and appropriate measures so that your personal information is managed safely at the outsourcing company.

Disclosure of personal information

When we are asked by the customer to disclose personal information based on the provisions of the Data Privacy Act of 2012, WIBS PHP Inc., will disclose it without delay to the customer after confirming that the request is made by the principal (If the personal information does not exist, notify that effect); provided, however, that this provision shall not apply to cases where WIBS PHP Inc. is not obliged to disclose such personal information under the Personal Information Protection Act or other laws and regulations. Please note that we will charge a fee (one hundred (100) pesos (including tax) per case) to customers for disclosure and correction of personal information, and suspension of use.

Suspension, etc. of use of personal information

In cases where a customer requests to discontinue using our service or to erase the personal information under the Data Privacy Act of 2012 on the ground that such personal information is being handled beyond the purpose of use published in advance or because it has been obtained by deception or other fraudulent means (Hereinafter referred to as the ” Suspension of use etc.”) and if it is found that the request has a reason, WIBS PHP Inc. shall, after confirming that it is a request from the principal, discontinue the use of or erase the personal information without delay and shall notify the customer to that effect; Provided, However, that this provision shall not apply to cases in which WIBS PHP Inc is not obliged to make such discontinuance or erasure under the Personal Information Protection Act or other laws and regulations.

5. How can you make corrections to your Personal Information?

When you request to correct, add, or delete any information (hereinafter referred to as “Correction etc.”) based on the provisions of the Data Privacy Act of 2012 on the grounds that the user is not true about personal information,

If the Company is requested correction, addition, or deletion (hereinafter referred to as “Correction etc.”) of its contents based on the provisions of the Personal Information Protection Act on the grounds that the user is not true about personal information, necessary surveys are conducted without delay within the range necessary to achieve the purpose of use after confirming that it is a request from the principal, and the contents of personal information are corrected based on the results and notify the customer of the effect (In cases where the Company decides not to make such a correction etc., the Company shall notify the customer to that effect); Provided, However, that this provision shall not apply to cases in which the Company is not obliged to make such a correction, addition or deletion under the Act or other laws or regulations.

We may change the purpose of how we use your personal information within the limit of reason in accordance with laws and regulations. You will be notified before the change takes effect by email, a blog, or an announcement.

3.Limitation of personal information use

The Company does not handle personal information beyond the scope necessary for the achievement of the purpose of use without the consent of the customers, except as permitted by the Personal Information Protection Act and other laws and regulations; provided, however, that this provision shall not apply if:

1. Personal information use is based on the laws and regulations
2. There is a case when the personal information use is particularly necessary to improve public health or promote the sound upbringing of children, and it is difficult to obtain the customer’s consent.
3. There is a case when it is necessary for a national organization or a local public entity or a person entrusted to cooperate to carry out affairs prescribed by laws and regulations, and there is a possibility that it may interfere with the execution of the affairs concerned by obtaining the consent of the customers
4. There is a case when it is necessary to protect life, body, or property of an individual, and it is difficult to obtain the customer’s consent

• “E-Wallet”: A digital account provided by WIBS PHP to facilitate payments and transfers.
• “DOPAY-EM and DOPAY-VC”: The service brands under WIBS PHP’s EMI and VASP licenses.
• “Loss”: Any liability, damage, or claim arising from the use of WIBS PHP services.
• “Personal Information” (PI) refers to any information from which the identity of an individual is apparent or can be reasonably and directly ascertained
• “Sensitive Personal Information” (SPI) refers to info about an individual’s:

  • Ethnic origin
  • Marital status
  • Age
  • Color
  • Religious, philosophical, or political affiliations
  • Health, education, genetic, or sexual life
  • Proceeding for any offense committed or alleged to have been committed by an individual
  • Government-issued IDs
  • Those established by an executive order or an act of Congress to be kept classified
• “WIBS PHP Account” Your account with WIBS PHP where transactions and balances are maintained.
• “WIBS” Refers to WIBS PHP INC.

HOW WE COLLECT INFORMATION

The collection of data is automated and conducted every time a user or visitor:

1. Visit the WIBS website or any of its systems such as: DOPAY-EM and DOPAY-VC.
2. Visit any advertisement for WIBS or any of its systems.
3. Visit WIBS accredited agents’ website, offices, premises, or their facilities.
4. Registration to DOPAY-EM and DOPAY-VC.
5. Transacting through DOPAY-EM and DOPAY-VC.
6. Filing complaints or inquiries to WIBS and any of its affiliated systems.

WHAT INFORMATION WE COLLECT

To align with the Data Privacy Act of 2012, information that can be categorized as Personal Information (PI) and Sensitive Personal Information (SPI) are collected.

• Login Credentials (Username, Password, PINs)
• Communication Records

• Billing Statement

• IP Address
• Device Type
• Operating System of Device
• Browser Type and Settings
• Referring URLs and pages visited
• Time spent on pages and clickstream data
• Language and Location (Based on IP)

Information that is collected by a third-party service:

• Cookie Identifiers
• Tracking Tags
• User interaction with ads (Clicks, views, conversions)
• Behavioral data across websites that uses these ad services
• Device and Browser related information
• Form submissions or usage logs

HOW WE USE INFORMATION

Legal and Compliance – Information is aligned with the respective domestic laws, regulations, and circulars, together with its amendments and relevant laws. These are but are not limited to the Anti-Money Laundering Act (AMLA), Data Privacy Act (DPA), Bangko Sentral ng Pilipinas (BSP) Circulars, etc.

KYC – Part of the safety protocols and establishing due diligence to compliance for every client, WIBS will use the information in conducting Know-Your-Customer procedures.

Marketing – In relation to research and establishing customer relations management, information will be used for these purposes. The goal is to help us understand how users interact with our website to improve their experience.

Internal Policies – Information shall be used to study and improve security policies under applicable laws.

Use of Cookies – The Company’s services use cookies and similar technologies to understand usage and improve performance. You can disable cookies through your web browser settings but note that doing so may limit access to some features of the service.

HOW WE PROTECT INFORMATION

WIBS will provide necessary and appropriate measures of supervision to its employees so that personal information is safely managed against risks such as loss, destruction, falsification, and leakage of personal information. In addition, when WIBS entrusts all, or part of the handling of personal information to the third party, the Company will conduct necessary and appropriate supervision so that the personal information will be managed safely at the outsourcing company.

HOW WE DISCLOSE INFORMATION

When requested by a customer, WIBS will disclose personal information without delay after verifying the request is authorized by the principal. If the information does not exist, it will be notified. However, this does not apply where disclosure is not required under the Data Privacy Act of 2012 or any other laws. A fee of 100 pesos (including tax) per request will be charged for disclosure, correction, or suspension of personal information use.

UPDATING OUR DATA PRIVACY STATEMENT

The Privacy Statement will be modified at any time to align itself with the updated laws and regulations. Every update will inform or be announced to our customers and partners.
